Willem Christiaan Engel (Utrecht, March 15, 1977) is the founder of the action group Viruswaarheid that criticizes the corona policy of the Dutch government. Furthermore Willem Engel is a dance teacher.

Engel was a scientist in Leiden, where he lived between 1996 and 2010. He did PhD research in Leiden and Enschede between 2002 and 2008. Since 2000 he also began to take an interest in dancing, in Zouk in particular. Zouk is a kind of dance and music from the French Antilles. After this he became a dance teacher. He has his own dance school called DA Dance Studio in Rotterdam.

He is now one of the most talked about persons of the last 2 years because of his statements and views against inequality and censorship and all the measures concerning the so-called health crisis

On March 30 he was released from detention.

According to reports, He is banned from posting on social media on penalty of facing 90 additional days in prison. This is a clear attempt to silence free speech.

Background

Baudet, a member of the Dutch House of Representatives and leader of Forum for Democracy (FVD), was sued for the tweets by 4 Holocaust survivors and two Jewish organizations (Centrum Informatie en Documentatie Israël (CIDI) en het Centraal Joods Overleg). The lawsuit described the tweets as “seriously insulting and unnecessarily hurtful to the murdered victims of the Holocaust, survivors and relatives.” [1]

CIDI released a statement at the time of the lawsuit’s filing, saying that “with these comments, Baudet puts the horrors of the Shoah on the same level as the measures against the coronavirus. He is minimizing the importance of the Holocaust.” [1]

One of Baudet’s tweets compared being unvaccinated to being a Jewish person during the Holocaust. “The unvaccinated are the new Jews, those looking away are the new Nazis,” Baudet tweeted in November. [1]

In an interview with Ilana Rachel Daniel on CHD-TV’s online show ‘The Jerusalem Report’, (see below) the Jewish Israeli host agreed with his comparison and noted that many Israelis have made the same comparisons, including holocaust survivors.

Holocaust Survivors also filed a suit with the International Criminal Court in the Hague making this same analogy.  They write:

“If 80 years ago it was the Jews who were demonized as causing infectious diseases, today it is the unvaccinated who are accused of spreading the virus,” they write. The Holocaust survivors concluded their letter as follows: (2)

This case challenges the free speech of a politician to make comparisons to the Holocaust.

Decision

The judge ruled that lawmaker Thierry Baudet needs to delete four tweets he made comparing coronavirus measures and the Holocaust. [1]

“The right to freedom of expression for a representative of the people is not unlimited,” said the judge during the ruling. For each day that the tweets remain online, an additional €25,000 will be imposed on Baudet as a fine. [1]

“By equating in the messages, without any nuance, the situation of unvaccinated citizens with the fate of the Jews in the 1930s and ’40s, you make a comparison, as I said earlier, that is factually wrong and you wrongly use, in other words, you instrumentalize, the human suffering of Jews in the Holocaust and the memories of them,” said the judge during the trial. [1]

Baudet has 48 hours to remove the tweets before the fines begin accumulating. [1]

“The comparison you made in the contested posts goes beyond what can be justified in the interests of robust public debate,” the judge hearing the case said. The judge’s name was not immediately available. [1]

 

Aftermath

In a reaction on Twitter, Baudet called the judgment “Insane, incomprehensible.” [1]

“We are angry and combative. And of course we will appeal,” he tweeted. [1]

The Jewish groups that started the civil case against Baudet welcomed the ruling, saying in a statement that it “made an important contribution to indicating the limits of the public debate.” [1]

Background

Jeroen Pols asked for an emergency court hearing following the government’s decision to make a negative PCR coronavirus test result mandatory for everyone entering the country from December 29. [1]

The use of the PCR test restricted his fundamental Rights of Freedom of Travel without hindrance in and out of his home country, as this was against agreed to by the Dutch Government, the EU and the UN. [1]

Mr Pols had been on holiday with his family in Tanzania, making him one of the first to experience and challenge the new restrictions. [1]

Mr Pols is also a partner in Virus Waarheid, a Dutch Legal office that fights for fundamental freedoms formed by Lawyers Pols and Willem Engels

According to the Virus Waarheid website:

This is Virus Truth We fight for the preservation of a democratic constitutional state in which our children still have the opportunity to develop themselves in freedom and to live a life with their own beliefs and opinions. These freedoms and fundamental rights have been increasingly compromised over the past decade.

 

Significance

This case is a fundamentally a human rights case and it tests the Dutch government’s interest in upholding liberty and the principles it has sworn to protect, such as the freedom to travel without conditions.

It also puts into question the reliability of the PCR test to diagnose the disease covid.

 

Plaintiff’s Argument

Mr Pols stated in an interview with France Soir (see below): [2]

  • This is a violation of the Treaty of Rome Article 2 which states the Right to Freedom of movement in and out of your own country.
  • The test is also an intrusive test. Which means you have a right to refuse it.
  • You cannot be forced to a medical treatment.
  • A diagnosis can also only be made by a doctor and not by a test.

Decision

  • The court agreed that his family could return from Tanzania “without having to produce negative coronavirus tests” [1]
  • The Judge ruled in favor of the defendant and also stated that the PCR test is not a valid indicator of illness. [1]
  • The court in The Hague ruled that Pols’ family can return from the high risk country on January 3, 2021, “without a negative test and ordered the state to pay the legal costs” [1]
  • The judge said the family have the right to protest about being forced to undergo a PCR test against their will. [1]

‘Introducing such a requirement for citizens of the Netherlands who want to return home requires legal grounding, and this is not covered by article 53 or 54 of the public health act,’ the judge is quoted as saying. The fact that further spreading of the virus needs to be tackled urgently is not up for discussion, the judge said. ‘But such a far reaching obligation as this, which concerns physical integrity, requires a concrete legal basis.’ [1]

 

Aftermath

  • The Dutch state has continued to insist on PCR tests as a condition for many activities including travel. [1]
  • A spokesman for the court told the Telegraaf that the verdict only applies to the three people in question and does not mean that ‘everyone coming from abroad can wave the verdict around and refuse to undergo a test.’ [1]
  • Jeroen Pols states that “every one can use this verdict”… “You do not need permission to travel!” [2]
